Warranty

MPM warrants the supplied product in accordance with Articles 1490 et seq. of the Italian Civil Code.

The warranty period is one year from the date of delivery of the goods. The warranty consists of the free repair and/or replacement of the defective part. Transportation costs for the product shall be borne by the purchaser.

The purchaser shall forfeit the warranty rights if hidden defects are not reported within eight days of their discovery; for apparent defects, the reporting period shall run from the date of delivery of the goods. Notification must be made in writing (registered letter or certified email/PEC).

MPM reserves the right to verify the existence of the defect. MPM also reserves the right to replace the entire supplied product.

The warranty does not apply to parts damaged during transportation, subject to normal wear and tear, deterioration caused by weather or environmental conditions affecting both colours and materials, damage caused by accidents, impacts, improper use, misuse or unauthorized use, or damage resulting from unauthorized modifications, repairs, or tampering.

MPM declines all liability where the product has not been properly installed or where the required maintenance has not been carried out.

The actual use of the product requires prior assessment by a qualified designer or engineer, who must take into account the actual installation conditions. Information contained in catalogues, orders, delivery notes, invoices, or any other documents describing the product characteristics shall not be considered sufficient to replace any design activity or technical verification required for the proper installation of the product. In all cases, correct installation procedures must be followed. MPM declines all liability arising from the use of profiles in situations that have not been subject to the aforementioned assessments and verifications.

Production Tolerances

Weight, dimensions, colours, and material characteristics refer to the sample product. Compliance of the supplied product with the sample shall be subject to normal manufacturing tolerances. Product performance may also be affected by the environmental conditions of the installation site.

Limitation of Liability

The maximum compensation available under this warranty shall not exceed the amount paid by the customer for the purchase of the product in question. Compensation shall exclude, without limitation, damages for loss of reputation, loss of business opportunities, loss of contracts, loss of revenue, loss of profit, or any similar indirect or consequential damages.

Heat

Product performance is affected by temperature. In environments with temperatures below 0°C or above 50°C, product performance may be reduced.

Colour

Colour retention and brightness are affected by wear and climatic conditions, which may reduce colour intensity over time.

Specific Provision for the T-Suspension Product

With specific reference to the T-Suspension product, MPM declares that it is suitable for assembling surfaces (ceilings, floors, etc.); however, its use must always be preceded by appropriate engineering and design assessments, including a specific evaluation of the panel weight and the intended purpose of the installation, particularly regarding the load that the assembled surface must support in relation to its intended use.
